Collusive "NON-LITIGATION" agreement between trustee (former Sheppard Mullin client, Hitchman Fiduciaries) and favored beneficiary - ordered by then-Commissioner Heisler (former Sheppard Mullin lawyer). Interested party BofA (you bet - also represented by Sheppard Mullin - that also represented Hitchman Fiduciaries). No justice for beneficiaries!

I have had dozens, if not 100's of hearings with Commissioner Heisler, dating back to when he was still a probate examiner sitting as a Temporary Judge. He is very smart, even keeled, and considers the evidence and law. He generally makes the correct rulings although I sometimes have not agreed. He is a bit slow with his calendars as he does pontificate and talk too much. But generally, you are much safer with him then some of the other judicial officers in the probate department.

Comm. Heisler is pleasant and friendly on the bench. He listens attentively. Pontificates a bit but nothing I haven’t seen before. The biggest problem is he cannot seem to make a decision. Wrings his hands. Takes even simple motions under submission for months on end. Will never rule from the bench when often that would be exactly the right thing to do — and would get matters off his plate. Is always WAY behind on his rulings. Being in his court is like being in purgatory for eternity. There’s no way out!
