Judge Ashley not only heard a cast that should have clearly been dismissed in magistrate court as they failed to prove jurisdiction, she actually entertained hearing the ADA request a motions hearing for a motion he indicated he had yet to write, to change bond information on a case that was one month away from being a year old. The ADA admitted that he had filed literally nothing into the case and yet Judge Ashley failed to dismiss the case for lack of timely probable cause, lack of proof of jurisdiction and failure to prosecute from the ADA. Verbally Judge Ashley scheduled a follow up court date but failed to have it put on docket. The cited party showed up 2 days before the court date to see if the ADA had filed anything, which was negative, only to discover there was no court date entered. The cited party left Judge Ashleys office with a stamped note showing there was no case scheduled, and to cover the discrepancy, Judge Ashley had entered into the case that the court date had been cancelled, when it had never been entered. The case fot misdemeanor traffic violations is still open and over a year old with a failure for ADA to prosecute, along with a second case that will be a year old by next month also jurisdictionally challenged, failure for ADA to prosecute and with major court tampering issues to boot. The second case should have been dismissed yet, the magistrate Lora Davis of Calhoune County (not available to evaluate on this website) allowed a city officer to file a complaint over a month after jurisdictional challenge, the officer asked for the original charges to be dismissed (they were) and that the cited party (for minor traffic infractions) be arrested for those same charges with "obstructing an officer" added to the complaint which was never part of the original charges the month prior. Once the case was moved to circuit court, it has stayed there under Judge Ashley but has not been heard and will be a year old in September. Subject was arrested under this complaint that failed to state exactly how and why new charges were allowed when that is against WV rules of court. This again displays the corruption of Spencer, Roane County, Calhoune County and the State of WV per it's official actors and the cited party has absolute proof of all claimed herein.
