Automatic 170.6. Cannot be counted on to read papers or follow the law. Rather, Judge Murphy shoots (wildly) from the hip. He is not prepared (at hearings, he does not even appear to have read the papers but skims through them during the hearing) and thus swings wildly in his comments during hearings, rules during one proceeding on matters set to be heard later, expressly disregards holdings of published decisions if the holding is not consistent with "how i do it". If you want chaos from a judicial officer, stick with Judge Murphy. If you want predictability in the judicial process, i.e., papers read and law applied notwithstanding "how i do it", 170.6 him.

(the motion must be filed within 15 days of receiving notice of the assignment of this judge and or BEFORE your scheduled hearing within 15 days of the party’s first appearance, whichever is later) This judge has repeatedly demonstrated a lack of diligence, failing to read critical filings and consistently issuing rulings that overlook key arguments. His approach appears to be one of minimal effort, often relying on tentative rulings without adequately addressing the substantive issues presented. He has already done this three times because we can’t change judges at this point. You have been warned. During oral hearings, he seems unprepared, scrambling to understand pivotal points as if encountering them for the first time. Despite valid oral arguments highlighting oversights in his tentative rulings, he rarely, if ever, amends his decisions. This pattern suggests a concerning level of disengagement and a disregard for thorough judicial review. For the integrity of your case and to ensure a fair proceeding, it’s imperative to exercise your right to challenge his assignment promptly. Delaying could result in irreversible setbacks and unnecessary complications as it has already done to me. This judge based on all prior reviews and comments should have been removed from the bench by his peers a long time ago. Just Terrible.

Judge Murphy is weak in law and motion matters and not much better in trial. He issues tentatives, reverses himself, and seems to base his decisions on what side he does not like. Great judge for simple personal injury cases, but not much more.

He had a clerk who was extremely disrespectful. I'm not sure if she's still there.

Judge Murphy is imperious. Jumps to conclusions that are neither based on fact or law. He thinks he is smart and judicious but he is not. He was recently totally reversed by the Court of Appeal in a published opinion (construction case). He likely cost the litigants hundreds of thousands of dollars and years of delay bringing a case to trial as a result of his erroneous rulings. An automatic 170.6
