Magistrate Nuffer wasn't very bright in private practice and was able to wrangle an appointment as a magistrate by some miracle. He is beyond his abilities as a magistrate judge not having dealt with complex litigation before. He really isn't familiar with actual, complex litigation having practiced in a very small community for most of his professional career. He is certainly intelligent, but because he doesn't have real world experience, gets quickly beyond his abilities other than routine scheduling and simple discovery disputes. He knows computers and technology well. My suggestion is to NEVER allow him to manage cases as his is very impatient and thinks he knows more than other seasoned attorneys in complex litigation. You're much better off having a "real" judge that is familiar with the rigors of litigation handle your case.

Judge Nuffer has a refreshung, real-life approach to civil litigation, undoubtedly because he practiced as a civil lawyer for years. He is courteous and respectful, smart and prepared. He also is very interested in technology issues as they relate to practice with the courts, and has been a leade in electronic case filing in Utah.
