I am a victim of rape, I was assaulted and almost killed by my exboyfriend. Please keep in mind that we had already broken up and I was in the process of moving out when he raped me and beat me. I called the cops and moved out immediately. Then i requested a restraining order on him and two weeks later he requested a restraining order against me which was clearly retaliatory. presented the evidence of how beat my face, body, neck, and low extremities, I had the police report. The judge threw out the report however the law states Evidence Code §?1280 -A writing made by a public employee, within the scope of duty, at or near the time of the act or event, and prepared in a trustworthy manner is admissible to prove that act or event. Police reports fit squarely within this section(a) The writing was made by and within the scope of duty of a public employee.(b) The writing was made at or near the time of the act, condition, or event.(c) The sources of information and method and time of preparation were such as to indicate its trustworthiness. My Attacker (ex-boyfriend) hired an attorney and the judge Cohn had clear bias. My ex had the mother of his child who is not a credible witness since she receives monthly payments and there's a clear history of domestic violence and abuse between the two. She testified that she heard over the phone that I struck him the day after I he raped and almost killed by him. At the end of the trial Judge Cohen stated that he did not want to minimize my experience but that he thought this is just a love triangle bird fight. This judge was willing to ruin my future and career because he does not see anything wrong with being raped and does not have the discernment to look at the clear history of a man that has been accused and arrested for rape and domestic violence, He ignored the law and had no intention of enforcing the law. Women need to be protected, especially from men that have a history of being predators.
