This judge recently had two cases where the 5th Circuit Court of Appeals had to overturn two separate convictions (see No. 11-50482 & No. 11-50484) that he presided over. The Court of Appeals sent this message to the Honorable Judge Frank Montalvo: "...we nevertheless conclude that the district court’s participation in the plea negotiations warrants reversal in this case. For all of the reasons we have discussed, the district court’s error “seriously affected the fairness, integrity, [and] public reputation of the judicial proceeding.” See Broussard, 669 F.3d at 553 (citation omitted).

This judge is arrogant, impatient, and rude to parties and counsel he does not like. He interrupts both counsel and witnesses frequently. He will take over the prosecution if the government is not performing as he likes. Once, he made me refund a fee as proceeds of criminal activity and not as counsel for a co-defendant, when the source was the same payer, and had the same bank account and the same money. I turn down cases that are assigned to him.

Judge Montalvo is the greatest judge I've practiced before. His wisdom is beyond belief. I tell my fellow attorney's that he is touched by God. His integrity is unquestionable. I wish that more judges would be like him. I've bee practicing for 35 yrs., former prosecutor and practice in Colo. and there is no one that I know of who has or is a better judge.

Although inundated with almost all the public corruption cases in the region, he ensures that civil litigants receive a fair and expeditious handling of their cases. He is no-nonsense, disciplined and hardworking, yet he has shown an understanding and compassion that results in a well-balanced and respected judge.

A true conservative Republican. Predictable on some of his leanings in favor of corporations. However, he is not a complete ideologue. I have been surprised at his even-handedness when it came to some civil rights and discrimination cases. While he is harsh on certain types of criminals, he also demonstrates great compassion in the appropriate cases. Agree or disagree with him, no one can deny that his decisions have integrity.

I completely agree with "mercurial." Additionally, I practiced before him in state court and he seemed to be lost on some legal issues. His election and appointment are, for the most part, a result of political connections. He is as qualified to be a federal judge as George Bush was qualified to be President.
