This guy is insufferable. He randomly decides to “work from home” when he is on duty. He made my colleague sit on his porch, in pouring rain, and she’s SEVEN months pregnant. Oh by the way, he knew she was pregnant. For a Mag Judge, this guy is insufferable.

Magistrate Judge Harvey is a consummate professional. He was the mediator in multiple cases in which I represented a party to the dispute. He was thoughtful, clever, and respectful. He kept the conversation going even when it seemed to stall.

The information below about Judge Harvey is wrong. Defendant Sibick was initially ordered released by a different magistrate judge in a different judicial district. Judge Harvey, by the way, is an excellent magistrate judge with stellar judgment.

In my opinion, Magistrate Judge G. Michael Harvey has incredibly bad judgment. He released a defendant charged in the Capitol Riots on a no-bail basis. The defendant, named Thomas Sibick, had been involved in the severe beating of D.C. Police Officer Michael Fanone. Sibick took the police officer's badge and radio home with the defendant as a souvenir. https://www.wgrz.com/article/news/crime/buffalo-man-faces-federal-charges-after-involvement-in-united-states-capitol-insurrection/71-beb4f492-866e-4b27-a664-92345a487b87 Defendant Sibick lives within 1/2 hour of the Niagara River, where he can easily flee to Canada by small boat as other fugitives have been doing since the early 1800's. Magistrate Judge Harvey exercised incredibly bad judgment in not jailing this defendant pre-trial.
