While this judge appears at all times to be very calm and well tempered, he is most definitely egregiously biased. Not as impartial as one would expect a judge to be and it seems he weighs in heavily on his personal opinion and views and feelings about a matter which is not appropriate for a judge.

I put forth a comprehensive legal analysis on behalf of my client, and Judge Polk simply denied relief without stating any basis or even indicating an awareness of the legal issues, purpose and intent of the law, etc. He failed to engage in any kind of deliberative analysis which judges will often do even when they deny relief. Further, Judge Polk made hyperbolic comments in the form of rhetorical questions based on what appeared to be his personal belief; however, he failed to acknowledge any counter arguments that were supported by legal rational and authority. It seemed as if my zealous advocacy for my client was just a waste of time. In other words, the judge's mind appeared to be made up without any objective, qualitative or reasonable basis. I felt disheartened for justice. It's not that I believed my client was entitled to relief. I've had other clients that have been denied relief in other courts of law, but justice was served because it was an objective and fair process. Without a doubt, that was not the case here. This judge's approach and lack of reason appeared out of context with the law and current circumstances of the case. As an aside, the DA made a false statement of law as a procedural objection and the DA knew the statement to be legally inaccurate and failed to correct it even in the face of controlling authority that was adverse to the DA's position. Accordingly, Judge Polk intentionally failed to address or moot the false statement of law.
