Long story this judge allowed the state to admit a recording that my wife took of me into the trial. We argued that the statue that codified spousal privilege controlled, because the issue is a substantive right. He ruled the issue was procedural so the rule controlled. [Redacted by Ed.] the prosecutor McDevitt walked up to us before the hearing all cocky, after submitting the most lazy argument ever, and started asking my attorney about his golf swing. Watch out if you have this dude handling your case! He has 125+ cases go to the appellate court since 2014.. that’s a lot of disagreement.
