Judge Whitman's evidentiary rulings during trial were biased in favor of plaintiffs' counsel and appeared to be based on favoring the sexual orientation of plaintiffs' counsel. The judge also incorrectly released a juvenile police report with video recordings which the juvenile court precluded from being released and which plaintiffs' counsel refused to produce during discovery citing the ruling and protective order of the juvenile court; such release during the civil trial was contra to significant case law and requires a motion to the juvenile court prior to use in any civil trial. The judge also allowed evidence of damages which had neither been described by plaintiffs during their depositions nor in the answers to written discovery nor in their supplemental answers to discovery served one month prior to trial. The case is currently on appeal.
