Kathleen J. Prendergast

A normal judge would have thrown out the petty barking dog case. Kathleen Prendergast is not a normal judge:

[Redacted by Ed.] she suppressed an unconsitutionally obtained a warrantless DUI blood test and turned around and let the equally corrupt DA prosecute it with no other evidence at a bench trial. Naturally found me guilty of a general DUI/Drugs claiming, "Well I know she's addicted to something. I just don't know what it is!". No alcohol was found in my system and every drug and alcohol evaluation came out clean, yet she still had the abuse of discretion to (extrajudicially) tell PENND.O.T. I must have ignition interlock for a year. Forced me to waste all kinds of money just to be a vindictive witch who is incapable of being fair if it means other (cronies) did the wrong thing. I do not drink or do illegal drugs, so stay out of York County. This witch is just plain EVIL.

So this judge is very passive aggressive, especially if you don't have a lawyer. She would ask me a question and when I tried to answer she would interrupt and shout me down. Then when I would try to finish my answer she has her sheriff's deputies shout you down and tell you to shut up, etc. Why ask if you don't care what the answer is? She's very insulting, too, for no reason. If you agree to a bench trial with this judge you are basically giving up your right to a fair, impartial trial. She also lets lawyers she likes get away with stuff that just isn't allowed. Pro police and prosecution. Very rude and undignified. Thinks she knows the law better than anyone. She should, but she doesn't know criminal law and gets overturned alot. It's too bad PA doesn't have a rule like California where you can pass on your first judge. I doubt anyone would pick her if they had a choice. BAD NEWS.

` This judge makes up her mind before you come into court and if you try to advocate for yourself she takes it personally and makes it 10x worse. Her credibility determinations defy credibility and she's very quick to assail yours. [Redacted by Ed.]

Comments: This judge is abusive comes into the court with a formed opinion you have no chance at justice. She wants power and control,she will fine your thousands of dollars if you challenge her.She fabricates testimony and injects her opinions as if they are true. She manipulates court orders and records to get at the person she does not like , freely insults people in opinions and orders. Criminal activity is ok with her she claims she is not a criminal court go file something in another court if you don't like it.Incompetent unable to keep facts straight. what your case is about becomes irrelevant the outcome will be what ever she wants even if someone gets physically hurt by her orders she does not care. this is a dangerous judge. her staff gossips to the attorneys so the attorneys know the outcome before walking into the court.Once your in her court you can not get out, she is a bully and unconscionable miserable person with no remorse for hurting anyone.
