Pros and cons. I credit her temperament and that Judge King seems to recognize the stresses of being a trial lawer. And, I think Judge King makes a conscious, serious effort to be fair to both sides, which is more than one can say for perhaps the majority of Judges. That said, short court days, especially starting late consistently, was wasteful of time and created issues with scheduling. Also, very unpredictable and what I believe were some truly off legal decisions on major issues. Not the worst place to be, but my advice is be prepared for trial to go twice as long you expected, and have everything briefed in advance to the extent possible.

Judge King is now the primary medical malpractice judge handling high exposure civil litigation on behalf of the biggest hospitals in NY Supreme (not Brooklyn). She is ill-suited for the task. Her scholarship on the law as it pertains to these cases is minimal to nonexistent. A third-year law clerk writes her summary judgment decisions; they customarily take over a year to decide and are almost always factually or legally inaccurate, devoid of reason, and entirely omit consideration or reference to basic legal premises like proximate cause. It is candidly disrespectful to the lawyers who work tirelessly on these cases and will undoubtedly result in a lack of judicial economy as decision after decision is reargued or appealed.

The absolute most incompetent judge that I have appeared before in my 17 years of civil litigation practice within the federal and state courthouses of NY and NJ; I also served as a law clerk, as well, at the start of my legal career, so I do have experience working with judges directly. Both parties filed respective SJ motions in April 2023 and now, in September 2024, after emailing and phoning Judge Kathy King's chambers on several instances, neither SJ motion has been decided. This is incredible. How long does it take to decide that there is a genuine issue of material fact that warrants the denial of the respective motions and set the matter down for a trial date? This judge is absolutely unfit and I have no idea how she was appointed. She needs to be removed ASAP to protect the public.
