WHEN DOES CIVIL BECOME CRIMINAL? Under Rule 42(a) of the Federal Rules of Criminal Procedure, the Judge in a summary criminal contempt action must certify that "the judge saw or heard the conduct constituting the contempt and that it was committed in the actual presence of the court”. If that’s so…A person who willfully disobeys a ‘lawful writ process, order or judgment of a court by doing an act or thing therein or thereby forbidden, if the act or thing done also constitutes a CRIMINAL offense, shall be proceeded against contemnor’. Simply put - The disobedience of a court order directing an act for the benefit or advantage of the opposing party to the litigation. So…As a NATIVE AMERICAN PARENT, INDIVIDUAL, and DECORATED VETERAN (who has rights according to the Constitution) how would you define this? Is it Civil or Criminal Contempt? Or both? Federal Rules of Civil Procedure (Fed. R. Civ. P. 1) for Contempt State(s) - “To hold a party in ‘Civil Contempt’, a court must find that 4 elements have been established by Clear and Convincing Evidence.” The existence of a valid decree of which the alleged contemnor had actual or constructive knowledge. That the decree was in the movant’s ‘FAVOR’. That the alleged contemnor violated the terms of the decree and had knowledge (at least constructive knowledge) of such violations. That the movant suffered harm as a result. See. Ashcraft v. Conoco Inc., 218 F. 3d 288, 301 (4th Cir. 2000). While Federal Rules of Criminal Procedure for Contempt State(s) - ‘Criminal contempt is administered as punishment for acts already committed that have impeded the administration of Justice in some way’. What if the ‘County Officials’ are the one’s committing the contempt under Deprivation of Rights Under Color of Law (TITLE 18, U.S.C., SECTION 242)? See. Cox 706 So. at 47. See Hanono v. Murphy, 723 So. 2d 892 (Fla. App. 1998). See. First Mariner Bank v. The Resolution Law Group P.C. etal., Civil No.

All these horrible comments about this judge she doesn't care about these precious children that means so much to the parent that's trying so hard and doing all the things they're asked and then she uses the word non-offending like it's something that is god-given to her to parade around somebody needs to please stop her you know why does defense attorneys average people nurses very upstanding people have horrible lives after they go before her and she's still in office what is wrong with people why why don't somebody do something we need Jose Baez please I hope he reaches out to help us

Judge Linda Babb sent my precious 2-year-old granddaughter 1800 miles away to strangers she she had only visited her non-offending father three times because he lived that far away and he was called to court when my daughter was assaulted and a child happened to be in the presence she was never given a fair chance at all the decision was made they brought the car seat down with them how would they know they were taking the child home the decision was made before we even made it to court this child has suffered greatly at the hands of this so-called offending non-offending father who wasn't on the birth certificate who wasn't didn't do a DNA judge Bob really does not care about children if she did she would look deeper into the so-called non-offending parent their background is sometimes the worst thing that anybody could ever send a child to she is very biased and does not allow really looking to what the child is going to go through at the hands of the so-called non-offending parent with no background check from the state of Florida our family has suffered horribly because of her decisions but worst of all my granddaughter suffered greatly do your best to avoid her at all costs because she will destroy you because no one stops her

If there was a negative number I could pick to rate this Judge's performance, I would pick negative infinity! This judge thinks she is above the first amendment and she ignores case law and she is completely racist, biased, and women-hating person. I appealed her order in the appellate court and I won, all three Judges took my side. If you are a minority then please stay away from this judge!

I had a case before Judge Babb 20 years ago. The case drug out for 15 months. It looked as though the case would be lost but the defendant committed perjury. Judge Babb was right on top of the details of the case. The case was complicated and required alot of reading to stay on top. Judge Babb performed as well or better than other district Judges in Pasco County. I would gladly appear again in her court. I now practice in Washington DC.

I have an injunction placed on me from an ex girlfriend who lives in central Florida now. I jumped through every hoop that they told me to. Julia Pulaski the clerk was pretty much advising me exactly what I need to do to open the case back up. When I first got served the papers I was given four days until the court date that was an option so I had to go through the whole portal system they have. I ended up just overnighting paperwork after finding a notary at 11 o’clock at night because I had to have the paperwork there by the next morning. The case was reopened. I got reserved again for a new court date and hearing. I listened to three different cases for over two hours, and these are teenagers bickering about this and that basically teenage stuff. We get called upon. And it’s almost as if she had her mind made up already. There was no hearing she didn’t give me the time of day and just wrote denied the clerk ms. Pulaski Knew she had done wrong by advising me. they then had a moment to look at each other and that was it. Corrupt? I drove seven hours and spent a month preparing for a hearing that lasted 60 seconds. Lidacris bias Linda Babb.

Unacceptable. She rubbed and played with her dog the whole time while my ex-husband admitted to hitting me. He was a deputy that worked for her husband. My ex-husband had raped me in the military. His new girlfriend tried to kill me and our kids. Judge Babb is not professional. She is biased. She has ruined and destroyed my children. She needs to lose her license. I am a registered nurse and she treated me like scum and that it was ok for a deputy to hit his wife and children. I will start a petition against her with the facts. She doesn't deserve her robe.

If there was a 0 rating I would have chosen it. I was a defendant in a recent injunction hearing. The judge kept asking the plaintiff for exact dates and times in which she said is the law but the girl could not give dates and times. The judge also looked up my witnesses criminal background and ask him an open ended question and then called him a liar when it was said that the question was misunderstood and then she made comments like he was a felon and he had been in prison and at that time she awarded the injunction on that and not the facts of the case. She then preceded to call me a fool and I didn't appreciate the name calling from a judge that doesn't even know me personally. Something was said from the plaintiff that I had Marchman acted her boyfriend which was my Ex and we had been in a relationship for 12 years. The judge made the statement that I can't change him and I said Ma'am I don't want him to die of a drug overdose and the judge states "well you have no control over that now do you." What right did she have to express her opinion on that and would she have felt the same if it was her loved one. She was rude and my opinion unprofessional speaking of things that had nothing to do with the case. She did not look up the plaintiff's extensive criminal record and make it public in the courtroom but she did it to my witness. If she was doing this to prove credibility then it should have been done to everyone. I was treated like shit for no reason while I am a law abiding citizen and she sides with an actual drug dealer.
