Plaintiff filed a lawsuit against the Nissan dealership in Palmdale, California. Dealership told me I needed a part for my car, and a new battery. I explained that the battery was only a few months old. They said my part that I was replacing damaged my battery. After I paid almost $1,000 my car still had the same problem of not starting after sitting idle for a couple of days. I took the car back to Nissan. I asked to see the new part that was put in my car. They refused to show me the part. They gave me a refund for the part but not for my battery that they stole from me. I called the Department of Consumer Affairs. The representative came out and looked at the part that was allegedly replaced. He said that was the same part that came with my car when I purchased the car. I took my car to a repair shop in my community. He said my car was having problems starting because a CD was stuck in the CD drive and it was draining my battery!! He unplugged the CD drive, and it was fixed! I took Nissan to Small Claims court to get my $350 battery, and for pain and suffering. Commissioner Marcelo D'asero. presided over the case. There were three mechanics who represented Nissan. Commissioner Marcelo D'asero made sure I was the last case he called, and that no other litigants were in the courtroom or outside the courtroom. The commissioner allowed me to say a few words. He hammered at me for 30 minutes telling me how I didn't have a case. When I tried to speak he cut me off, yelling at me. I have never heard of a court case where the judge or commissioner NEVER ASKED THE DEFENDANTS NOT ONE QUESTION CONCERNING THE CASE! When the commissioner was finished beating me down, he looked at the three defendants and said "do you have any questions?" They said no. He ruled and gave me the money for my battery. He refused to give me pain and suffering. He then yelled at me to "get out of his courtroom."

Commissioner D'Asero held my case until the end of the day. He made sure no one was in the courtroom except me. I took my car to a dealership where I bought my car brand new. I had problems starting the car if I didn't drive for two days or more. The defendant dealership said I needed a new fuel pump and a new battery. I paid approximately,950.00. Two days after I didn't drive my car one day it still would not start. I took my car back to the dealership. I asked to please see the new fuel pump which was located under my back seat of the car. The manager of the dealership refused. He asked what he could do to fix the situation,and I asked for a full refund. He gave me a refund for the fuel pump he never replaced, but he refused to give me the value of the new battery that I paid nearly $300 that I had bought a few months before. I took the dealership to court for the cost of my battery and pain and suffering. There were three representatives from the dealership in court. I was alone. The case was simple and straight forward. I also showed receipts where I took my car to another mechanic and he said a CD was stuck in the CD drive and it was draining my battery! During the hearing commissioner would not let me speak. He would cut me off and offend me. I have watched lots of court shows and I have never seen a case where a judge never asked the defendants a question! After only awarding me the cost of the battery, he closed my case. The dealership lying about replacing my fuel pump was ignored. He said they made a mistake. He only asked the defendants, "do you have any questions" and they said "no". That was the end of the hearing. I was terrified!

I agree with every single one of these comments I went before Commissioner Marcelo D'Asero for a case regarding an eviction. He had no idea of my case. He kept saying “ oh I would have never signed this” as if he’s such a smart individual. Filled with pride and a lot of anger as I saw. He kept shutting me up everytime I tried to speak and when I would make a comment regarding my case he would start screaming literally yelling to shut me up. He was very rude and racist 100%. I tried explaining how the management company would not take my money for the rent payment and he insulted me saying that the management doesn’t want my charity money and that they want to get a paying tenant in there instead because I was approved by a “stay housed “ program to pay even more than what I owed but he said no and wouldn’t hear it every single time that I would speak he shut me up and even laughed at me and enjoyed telling me “ the sheriff is coming to lock you out “ the program protected me to not be evicted under a code until may 31 but he didn’t care. He is a cold hearted individual and I will not be surprised when he is all over the news when it all gets discovered and his dark secrets are exposed. That day will come rather quickly. He was evicting everyone and at the same time kept saying he didn’t know about the cases and didn’t want to work with anyone. He is a sad man doesn’t matter what title he has. Pride comes before the fall. He called me a poor person and told me to find a place to go. How does he sleep at night with such a conscious? all eventually comes to the light. Soon enough.

Commissioner Marcelo D'Asero displays mental health challenges during the hearings. Commissioner was unable to find information concerning different cases. Plaintiffs would have to remind the commissioner of his earlier rulings. The commissioner would often drop his head and shake his head repeatedly, as if Commissioner was having a nervous breakdown. Commissioner refuses to allow litigants to present their case when they ask at the beginning of the hearing. Commissioner reads case notes, then throughout the hearing Commissioner speaks the opposite against the documentation of evidence. When Plaintiff's attempt to correct Commissioner, commissioner yells and tells Plaintiffs not to speak. Commissioner also insults litigants in open court. As other ratings suggest, Commissioner D'Asero needs to be evaluated for mental disorders before drastic measures are warranted.

I sat in on a small claims calendar This man has no business on the bench. He is insulting to the point of cruelty to the litigants. He acts like he is sitting on the appeals court the way he badgers the litigants. Advice to anyone. DO NOT STIPULATE TO HIM. 170 if necessary. The man has serious mental health issues

This Commissioner is everything these comments say he breaks the laws, and my dad went to a civil court case he had because he got scammed and filed a lawsuit against this person that stole from him, and the Commissioner Marcelo D`Asero is completely racist telling my father not to speak in Spanish. He even said to my father that he could not present any evidence in Spanish. This commissioner is filled with hate and discrimination. It seems It seems he is in favor of the delinquents instead of the hard working individuals that pay their taxes. He is a DISRESPECTUL RACIST.

This guy is quite possibly the most unhinged person in any court in the country. he has Zero self control the slightest thing will send him into a psychotic state which he has a hard time coming back from. It is very sad to watch. he belongs in a psychiatric hospital.

Will not allow Counsel to present case. Interrupts, trivalizes the case and facts. Insults, Takes the facts, then bypasses the law, then gives his verdict. Justify interruption saying he only has minutes remaining. Does not allow defendant to answer to allegations, then dismisses the proceedings. Yells.
