Good judge to have in the district. Handles cases quickly and fairly. Good disposition. Generally inclined to deny 12(b)(6)'s and MSJs. Stereotypically pro-plaintiff and pro-criminal defendant. She does hold your feet to the fire. Not a crim lawyer, but a good litmus test for finding out who's laid-back and a good lawyer versus who's an overzealous douche in the U.S. Atty's Office is asking what they think about Vazquez. If they smile and roll their eyes but then recognize that there's a purpose to having judges like her = probably a good dude. If they become a huffy little b*tch and talk about how they can't believe how she shafted them out of xyz = dumb state school-educated chicken hawk youngster or worthless old boomer who probably wouldn't hack it in the private sector. (The U.S. Att'y's Office here is hit or miss on quality; there's plenty of each.)

10th circuit had to overrule Vasquez yet again on a simple suppresion of evidence. The case is ALFREDO ARAGONES,V USA 11-2142. The Judge held that for purposes of the Fourth Amendment the officer “seized” Mr. Aragones at the moment he ordered Mr. Aragones to remove his hand from his pocket. WRONG. He wasnt seized until the officer put him in cuffs. 2nd: Even overlooking this problem, however, a larger one exists. An Albuquerque public nuisance ordinance prohibits “[e]ntering upon any private property and looking into any occupied dwelling without the consent of the occupant or owner of the dwelling.” A reasonable suspicion of criminal activity like this is enough to permit an officer to effect a brief investigative detention. REVERSED.

I am a federal agent. Vazquez has been rated locally as the worst District Judge. I personally have had a case in front of her and it was a disaster! Someone please explain to me how a Federal District Judge who has a brother that was put in prison for narcotics charges still sits on federal drug cases?
