In a similar manner with Comment # 13465,Judge Ramos granted summary judgment in a breach of trust suit against a local prominent CPA Independent PR for taking PR fees of 15% of the estate's assets subject to administration (or $110,000 in excess of the max), plus an additional $45,000 in accountant's fees leaving the estate deleted with no assets to pay creditors and plenty of facts in dispute. The judge refused to correct the matter upon being informed under a Rule 59(e) motion. This was also amazing for a federal judge to make that sort of a mistake. Could only conclude that the fact of the local prominent defendant may have had something to do with the outcome.
