Poor guy is so over his head. The whole process of determining what the law requires and then applying the facts seems to be too difficult for him. So, he routinely tries to fashion an outcome he thinks is sensible without regard for the rules or really even the facts on the ground. But, he doesn't have enough background to really even get away with that approach either. His rulings are consistently in favor of whoever has the deepest pocket and frequently leave both sides scratching their heads about what the hell they are supposed to do next. I do not know his background, but I would guess he was a commercial lawyer who did a lot of transactional work in a very narrow area. He does not seem unintelligent but he is really not equipped to be a judge and should probably go back and practice another decade to get a better understanding of a how legal decisions are made.
