I have personal knowledge that this judge did in fact withhold a complaint in a case until the party cited with a traffic infraction was to appear in their first appearance. The party cited had already appeared within the "on or before" date of the citation to challenge jurisdiction of the court as there was only a citation filed at the time. The court failed to find probable cause within the 2 days timeframe per County of Riverside V McLaughlin, failed to dismiss due to lack of jurisdiction and Magistrate White signed his probable cause 1 month after it was written invalidating the form he signed. He threatened to jail the party if they did not sign the bond paperwork knowing that they did not comprehend at the time that the due process was already failed them. Magistrate White and the court clerks did collude to add an additional case but failed to let the party know there were in 2 cases to be addressed when the MTD paperwork was filed, even though the clerks were asked. The second case was created from photocopies of the first case with a second number written out of sequence which if FOIA'd would show it was indeed created later to find a way to trap the cited party as the court by this time was aware that the party would fight the citation. Spencer WV has a habit of unlawful practice and has been so used to not being challenged because it's citizenry is unaware of the law and their rights that the practice of the law enforcement and the courts are constantly in collusion and unlawful. The party has a paper trail of poof to these facts. Magistrate White was recused from the case however, the remaining magistrate was no better, nor the magistrate from the county nearest nor the circuit court judge who shall be informed upon on their own names.
