It's never helpful when a judge misapplies applicable legal standards, fails to understand a well-established legal argument, and declines to dismiss a harebrained, frivolous complaint simply because the motion was brought pre-answer. In addition, oral argument was conducted purely as a formality. Judge Ramsay had her decision written up already and she did not address anything raised at oral argument. A clearly erroneous denial of a motion to dismiss is now going to cost my clients thousands of dollars just to litigate to a foregone conclusion.
