Judge Hom wrote a memo against ordering Defs to pay for the Law Enforcement Investigation of accidents in DUI cases. In Sac, the DAs always asked for restitution to be made to the CHP (or any other LE agency) for their investigation of accidents when DUIs are involved. Judge Hom wrote an opinion that said the DA can ask for it but it will be denied. From that day forward, no judge imposed the cost of the investigation on Defs in DUI cases.
