Lead counsel for the state when they implemented this QIP program, said "We did not follow the regulatory process and we did not turn it into the APA and that is how the QIP is operating today. What else do you need but that. Well how about this. The statute where they put the QIP # 62757 in Chapter 3.5 of the Food and AG code was suspended when the Federal order came into California and the California order was gone. #62757The voting process was not done by the statue #62716, 1) did not have the required Hearing, 2) did not make a pooling Plan, 3) Did not make the ballot according to statue. The Judge should step down, as this decision costs hundreds of dairies over the next couple of years. It is an imposition of a tax without benefit and is a violation of the California Constitution. No where in the US allows private citizens take money from private citizens and had it over to private citizens. Something this simple, the Judge should have never missed it. He should step down before destroys anther industry in California.
