The 11th circuit vacated and remanded USA v IREY (08-10997). This is the most distrubing child porn cases I ever read. If you read the opinion be prepared for graphic testimony. This magistrate Judge sentenced this pedophile to 17 1/2 yrs. The Level 43 sentencing guidelines called for "Life" but because the statutue had a maximum of 30 yrs and prosecutors only filed a count which he pled guilty to - the judge used a 15-30 max sentence instead of 30-life and sentenced this pig to 17.5 yrs. He cited the pedophile for being a good husband and father. The defense hired a perv physch, Dr Fred Berlin, who said, Irey had a genuine affection and concern for the youngsters at the time and actually thought he was helping the little girls he was sexually abusing. He is otherwise a decent man. This so-called doctor needs to have his credentials revoked. Just read some of the evil deeds this guy did and what he filmed. The majority of the 11th circuit took over 130 pages to detail the actions and case law. the dissent took another 100, but all said this was the most disturbing case they ever read about. If the maximum was ever meant to apply to any case it is this one. This Judge is out of touch and absolutely unqualified to sit on any criminal case. Glad to see this pig will be resentenced and hopefully to 30 years.

Intensely hard working. Results oriented. Fiercely in command of issues. Reads all papers and knows them. Allows both sides full and complete time to make any argument. Other comments herein are superficial impressions. This judge is top notch.

Bitter, prickly, insecure, indolent. Affects a long-suffering, above-it-all, superior impatience with just about everything. Burned out and miserable in his job but afraid to move on. Increasingly careless and belligerent. Misunderstands well-established legal doctrines. Finds power intoxicating and can not resist churlish little punitive cheap shots in opinions.
