Judge Martone handled complex scientific evidence very well in the Zicam product liability litigation and admitted the plaintiff's scientific experts in a well reasoned Daubert opinion. Plaintiff experts had been excluded under Daubert in 10 prior cases in other districts. This judge is hard working and smart.

Judge Martone has shown himself to be inflexible and unfair. He has dragged a civil case, in which all parties have agreed to terms, for 4 months. This has resulted in the delay of payments to over 4,000 plaintiff's! The case was mediated in November of 2009 with no counter claims or objections filed? Please sign the document Judge!!! Judge Martone has displayed an appalling lack of judicial temperament and flexibility in dealing with the illness of a party's counsel which necessitated the retirement from parctice of that counsel. Instead of compassion, he lost his temper, issued an order condemning that well-respected lawyer in time of crisis, and ordered that the lawyer report himself to the State Bar. The Judge's conduct was reprehensible.
