In a high profile case she finds that a gun fired without the trigger being pulled. And the company expressly marketed that this would not and could not happen. And that plaintiff relies on this assurance in keeping his gun and that his testimony was entirely credible. Then she finds no deceptive marketing. One expects more from the system. Excellent judge all around. I would rather have her than any of the other judges. Very patient, hard working and intelligent. Her opinions are better than most judges, and the analysis , well developed.
She failed to notify me that she used to work for the same law firm as the Defendant in a Free Press lawsuit case -- Senator Kelly Ayotte. Worse than that my opposing counsel at McLane, Graf were her boss and co-worker, respectively. I am a former Federal litigator so I know better, but Judge Barbadoro blasted me with no legal analysis of my Motion to Recuse and just wrote it was "entirely without merit." Yah, shoor. 28 §USC455 Judge Barbadoro should recuse McCafferty for Ayotte/McLane ass'n in free press lawsuit. She then issued a number of false findings of fact in a TRO hearing that I allegedly posed some kind of threat to Senator Ayotte, what with my big, black camera or something but really I think it is more my big black skin and biting commentary on the feckless nature of Kelly Ayotte's reign as NH AG.
