Take caution with this judge. She comes across from the bench as neutral and open-minded. After having tried a case in her courtroom, her understanding of the law of evidence is shockingly lacking. Her decisions are not generally based on the law, but her concept of “fairness and equity.” Her TRO/PI against ICE was reversed by the Supremes, but she hasn’t been on the bench long enough for other of her decisions to be scrutinized by reviewing courts. Make sure that you preserve every issue for review. She rarely cites case precedent in her rulings (usually using the phrase “the case law holds” in the abstract). Her apparent disdain for procedural requirements is evident - do not rely on her chambers rules when she states “motions (etc.) that do not comply with this requirement will not be considered[.]” - there is unstated flexibility in her “requirements.” In fact, you won’t know what “requirements” are flexible until her final decision is issued. Expect to wait a long time to get a final decision from her. Good luck (you’ll need it.)
