Magistrate Judge James has consistently used procedural tactics to prevent cases from reaching the merits. Her rulings demonstrate a pattern of obstruction rather than neutral case management. She has a repeated practice of granting in forma pauperis status but withholding issuance of summons for months, sometimes over 120 days, leaving plaintiffs unable to serve defendants or begin discovery. She then denies discovery as “premature” because summons were never issued — a circular trap that ensures no case moves forward. Emergency preservation motions have been denied outright, even when evidence was at risk, under the same reasoning. This approach replicates the very predicate acts alleged against other officials in related litigation: suppression of filings, obstruction of access, and retaliation. The result is that plaintiffs — particularly those raising ADA, civil rights, or RICO claims — are effectively barred from accessing a judicial forum. Magistrate Judge James’s management of cases reflects bias, systemic stonewalling, and a disregard for the fundamental right to a fair hearing.
